My husband and I received custody of our two grandchildren many years ago. We went through the Salem MA Courts and after fighting for months way back them have been receiving child support from their father via DOR.
One of the boys fought to go back to live with his father making life difficult for us so we gave in and let him go. His father never went back to court to obtain custody and he never stopped the child support payments for that child. I every week mailed back the child support for 5 years. My grandson comes to me after 5 years and wanted to move back in with us which he did. After 6 months he wants to go back to his fathers after his father begs and pleads with him. He does but the school refuses him unless the father has custody which I then gave up. The father brought me a paper of release to sign. For some reason no one bothered to stop the child support. This went on for 2 years with me begging for him to stop the payments I was getting tired of running to the bank and post office every week. I was receiving 220.00 per week refunding 110.00 back to the father. I finally told him I was not going to send any money back to him until he took care of the situation. He went back to the Salem Court the next day funny after that many years he moved that fast. I received a letter in the mail stating that my child support had stopped for both boys. Clearly there was a mistake because the custody papers just have the one boys name on it. I called DOR they told me I had to go to the court to clear it up.
My husband went as he was out of work due to the economy and business was slow. In one way that was good because we were told that we needed a lawyer. We were able to get the lawyer of the day because my husband was out of work. She files papers for us and shortly there after we receive notice that we have a court date in two weeks. My husband goes again only this time he had to take time out of work. He gets there and sits and sits. Finally someone approaches him and ask him where the other party was my husband said he had no idea they asked him if he had notified the other party and he naturally said I did not know I was supposed to. Yes we were told we would have to get another court date that they had to notify the other party which was the father, no kidding!!!
This is the DOR making all these mistakes. The first mistake was that when the father asked to have the child support stopped instead of putting the original order into a judges hands like they should have someone from the DOR just stamped it processed and through it in a bin. This all goes back to August 2008. So now we get notice to go to court again this time we are told to go to Lawrence MA. My husband goes again. He was told to get there at 8:30 am which he did. He calls me at around ten and asked me the fathers address to be sure the DOR had the correct address which they did. Just when they were going to go in front of the judge without the other party present he shows up almost two hours late. In front of the judge my husband hears that the DOR lawyer filed the wrong paper work we have to go back to court that was December 4th 2008. We have made several attempts to find out what is next and we keep hearing the are working on it. We need help we do not know what else to do. My husband is still out of work and are owed thousands of dollars that we may never get. Mind you the father knows he is supposed to be paying this. It is no surprise to me that he is not that is why I was having it deducted from his paycheck in the first place. I can not even imagine what a young women with small children would do all alone without help something needs to be done to fix this problem
Can you help us they need to be made to come up with answers for people clearly this is there error.
