Trucking Company Refuses to Pay for Windshield

We were driving down US HWY 52 at approximately 5:00 on May 13, 2009 when something flew out of the trailor of the truck of Tri City Trucking Inc. which had a foot and half door and no cover for the stuff inside of the bed of trailor and shattered my windershield. I have called numerous times to only get the fax machine with the exception of once when I got a answer machine and left a message. A lady called be back and my girlfriend explained the situation and she stated it was not her husband driving the truck. She stated that the truck was hauling mulch. We were the 3rd vehicle behind the truck when something flew out of the back of the trailor and shattered my windshield. It sounded like a boulder had hit the windshield. My girlfriend was on the passenger side which is where the object hit the windshield. She stated she would have her husband to contact me back and he finally contacted us two days later and told my girlfriend not to call him again he was not responsible. My girlfriend tried to get the license plate number but was only able to get some of the license plate number (PT2790) and on the side of the trailor was T-145. We drove next to the truck to get the name and hopefully the phone number of the company. It was a red truck with Tri City Trucking, Inc. Walnut Cove NC on the side of the door. The trucker got off the Germanton exit, I am sure headed back to Walnut Cove NC. We did not follow him due to me being so upset. The next morning my girlfriend called the City of Winston Salem Police Dept and spoke with Officer R. T. Phillips and explained what had happened. He also tried calling and only got the fax machine. He did a police report #924468 and explained our options which were to continue trying to contact the company, filing a report with the Better Business Bureau, (which has been done), and the news stations.
At this point, I am asking only for the replacement of my windshield. I have contacted the Sheriff's Office in Danbury to get small claims papers to file with the courts if this situation is not resolved within the next 10 days. Which my girlfriend explained to the gentleman that called. If we have to go a court, we will also be asking for court cost, replacement of my windshield, and my girlfriend suffers from anxiety and stress disorder and she will not get in a vehicle at this time. We are all very lucky that the windshield did not shattered and cut her all up.
