We live in San Jose, CA and have a rental home in Oakdale, CA. We had a tree in the front yard and several trees in the backyard that needed cutting down and stumps grinded. We were referred to Eduardos Tree Service. After Eduardo went to our rental home, he called me on December 17, 2010 and gave an estimate of $300 just for the tree in the front yard. I said okay. He called me back later and said that he looked in the backyard and could do all the trees back there for an additional $450. I said okay as long he could them the same day. He assured me he could. He called about 1/2 later and said that they really need to have the stumps grinded to look good otherwise someone would always be falling over a stump and the total would be $900. I hesitated but said okay because eventually we would need it done and he was offering a good price he said because work was slow now. He told me to go to his bank and deposit $600 of the money so that he could pay his workers. I wrote a check and deposited the $600 in Bank of the West. However, it was not a business account I was depositing the money into. He said I could pay the balance of $300 when he was done. I didn't hear from him anymore that day. I called my renter and she said that they left and she didn't know what the plan was. I called "Eduardo" and he said that they would finish it on Wednesday, Dec. 22nd and since he had to pay for dump fees if I would put $200 in his account. I was babysitting that day and it was hard to go to the bank multiple times, so I just put in the balance of $300 in cash to the nonbusiness account. I found out the next day he never showed up. I have been calling him since December 22 and left numerous messages on his cell phone and he never calls back. I did catch him twice only by not revealing my phone number when I called (*67). He had promised both those times to finish and this last Saturday (Jan. 15) he said he "swears on my kids" that he will be at our rental home on Monday, 1-17 at 9:00. He never showed up. My yards are a mess (I have picutures).He did the same thing to my sister. She still has all the residue etc in her yard since two weeks before I verbally contracted with him. I told him how much trouble he could get into, but apparently he doesn't care. I heard that he was doing other people's trees the same time he was telling me he was sick and couldn't work. Nothing he says is close to the truth. He is scamming people out of their money.
