On Thursday, December 30, 2010, I bought a pair of Merrell shoes at this store. I am a nurse and have always bought my shoes at Sand Dollar Lifestyles. I normally get the Jungle Moc shoe as I have had a total knee replacement and this shoe gives the support I need. When I went to buy the shoes on Thursday, I told the salesman what I wanted. I saw a clog style and ask him about it. He took the foot pad out of the Jungle Moc style and the Encore style and told me how they were the same shoe due to no difference in the removeable foot pad. I got tried the Encore on and it felt good, so I bought that shoe. Naturally, I wore the shoes to work the next day. I am an administrative nurse so I am up and down but not constantly up on my feet. Well, by Friday night my feet and legs were hurting so badly that I could hardly walk. On Monday I went back to the store. The same salesman was there and I told him what had happened and that I needed to exchange the shoes for the Jungle Mocs. He told me that since I'd worn the shoes, he couldn't take them back. I asked him how one would know a shoe didn't work for them if they didn't wear it. He said he understood what I was saying. I told him that furthermore, I bought the shoe based on what he told me about the foot pads. I told him that $93.00 is a lot to pay for a pair of shoes that they won't stand behind. I told him that I had called the Merrell Corportation and they informed me that he was wrong in his telling of the foot pads and that the shoes were the same shoe. The Jungle Moc has a higher arch, and is wider across the toe area. This salesman told me he'd been with the company 7 years, and he understood what I was saying but they just did not exchange shoes once worn. First of all, I would think that someone who has been with a company seven years would know their products; secondly, their exchange sign should say that they do not exchange shoes that have been worn, as well as verbally tell each customer this. I'm sure that would cut down on their sales. The salesman told me that he understood what I was saying, and I told him that I wanted to make sure I understood what he was saying. I said to him, "Let me make certain I understand what you are saying; you're telling me that this company sales products to the public and if they don't work, too bad for the customer they are stuck with it?" He said, "Yes mam," and nodded his head in a yes position. He put my shoes back into the box and I left. I am also considering contacting the Attorney General's Office because I believe there have to be rules and regulations that govern things like that. I don't believe you can sell a consumer a product, take their money, and not stand behind their merchandise. And of course, the consumer has the right to see if it works for them or not. It's not like I kept the shoes and wore them for a few weeks or so and then decided I couldn't wear them. I bought them one night, wore them the next day, and knew they didn't work for me. I have tried finding the owners of this store chain and can't come up with anything. Anything you can do to help me get an exchange for these shoes, or at this point my money back would be greatly appreciated. Thank you in advance for your help and consideration.
