On Dec 28, 2010, I attended to an appointment at 12:00 noon in a clinic located at 64 Prince Arthur Avenue, Toronto, Ontario where based on discussions I agreed to have a surgery for the cost of $16,000. This appointment was conducted by MISS Spence.
I did pay the initial fee of $ 6000.00 as a down payment from my credit card to that office on same date December 28 2010.
I was subsequently introduced to one Dr. for a consultation, for which he took approximately three minutes. His conversation with me referred only to him being the person who would be doing this procedure on me.
I then booked an appointment for the surgery, on January 4th, 2011. The only screening they did for my health was sending me to a laboratory close to the clinic for a blood test and electrocardiogram. I then left the clinic around 1:00 PM. Before I left the office I asked the consultant about the contract for the surgery, she told me that there was no written contract in place. The only papers she gave me was the information about the care I was supposed to take before the surgery and the information about my family doctor.
This verbal agreement was made at the clinic located at 54 Prince Arthur Avenue, Toronto with Ms. Niki Spence.
After leaving your office and going over the train of events I felt uncomfortable to proceed with this surgery as I felt a procedure of this nature needed more information from the attending surgeon and your office giving me all pertinent details on any after effects of a procedure of this nature.
The nurse from Slimband called me around 9:30 AM the next day December 29th and I told her that I was not going to have the surgery as I was not too comfortable with my decision to do it.
I spoke to the consultant right away who she told me that the clinic were supposed to keep $2500.00 if I do not get the surgery done. She did not tell me this on the day I was at the clinic (I have a witness) that there was a penalty for canceling my surgery appointment. She did say that the only way I can have a full refund and give me the $2500.00 back was if I got a doctor’s letter stating why I was not supposed to have that surgery.
I took that letter on January 6.2011. Since then my doctor has been calling their DR because the consultant told me that my doctor has to talk to Dr Kundhal in order to get my money back.
My doctor has been trying contact this doctor. He has never replied to her. She spoke to the financial manager and he told her that she has to talk to the DR Kundhal directly.
I did cancel the surgery next day it was not even 24 hours after I was in that clinic.
Until now they are not giving me my money. and they do not answer my calls or emails.
