I started getting SSDI for a few years now, and since 2006 SSA has been messing up my case and been unfair with my medicare benefits.
They have lost paper work, which caused me to get my Part B benefits almost a year late, ignored my pleas to address problems with their "employer proof of medical insurance" form, and they even supposeably took care of my problem when I filed with Congressman Platt's Office, but then recently retracted without notice to me.
Suddenly, SSA stopped sending my monthly check. Not amused, and with no other income, I'm strapped for money. When I inquired why (because they never sent me any warning) over a month later, their response was, "We over paid you because you were not paying a high premium for not having insurance coverage".
Well, my fight is, I had Employer coverage via my exhusband's employers. I have proof. The problem is SSA will only accept one form of proof and that is a simple form that an employer who provided the health insurance must fill out.
Because I am now divorced, employers have privacy acts, and they refused to provide me with the signature and dates I was covered. They refused to provide me with the information even with a subpoena.
SSA says they will not accept old insurance cards, other insurance documentation or old bills as proof that I was covered. It must be that form! Until I show proof, I must pay the higher premium. They charge higher premiums for each year that you are not covered by insurance. That issue alone is unfair to those people who have companies who don't insure them or they can't afford insurance!
Obviously that rule is unfair to me any anyone who has been covered with or without insurance. I asked Congressman Platt's office to help me, and at one point he seemed to have resolved the issue. SSA gave me back pay for my overpayment of premiums to them.
Suddenly, my SSDI stops completely with no warning! They say I OWE them money over $1,700 from not paying the higher premium from not having employer proof! Even though I have been fighting them on this problem since 2006, even with my congressman's help, they are on me like a leach sucking all my money!
Instead of humanely sending me a letter and working out a payment plan, they just stop all the money!
People need to be careful about over paying or not getting paid enough money from SSDI. I need help fighting to get SSA to not hold lack of coverage against people to begin with! However, if we can't do that, at least have SSA insist that employers cooperate or SSA should file action against them! It's not my fault and I shouldn't be punished for the ill ways of former employers.
