The Wrong Way

We have recently purchaed a home, and part of the contract called for the seller to correct a few small items within the home before the closing date. Looking like the seller had made all the necessary contacts and the items we requested to be fixed had been addressed, we proceded with the closing. Upon moving into the home however; we found that the microwave still have not been completely fixed. We contacted the sellers agent and was provided with a copy of a paid receipt in full invoice for the work, however at the bottom of the receipt, it is noted the service department needed to return with one last part that he did not have on his truck when he made that 1st service call. With all that said we and the seller and I think the sellers agent have tried to contact this company to get them to finsih the work that they were already paid for. We still have not been able to have them return, even thought we were told on numerious time 5+ to be exact that someone would be returning to complete the work...a five minute job non the less! We have made special arraingements to make sure that we were home when they indicated the serviceman would return to finish the work. Today 5-24-07 in fact they were again to be here between 10 and 12. No one has ever called or shown up. I have left messages again at every number that is listed, and sent the customer service department a e-mail, begging for a reply, because it seems no one ever picks up the phone at the business! I have now contacted the BBB and filed a formal complaint, and I will be contacting our legal council to see what our next course of action should be. I told the company at one point when they did call back, that they should just refund the full amount and let us take our business elsewere to stop this aggrivation, they didn't even respond to that. I feel that this company needs to be investigated. I have made copies of the company's mission statement, and have left message that I would be calling the BBB and Complaint TV, plus our legal council. This has been ongoing since 3/24/07, and again today is 5/24/07. I would hope that you would agree this is newsworthy! I look forward to speaking with someone from your trouble shooter department to hopefully get this resolved!

We are having a problem with Smartway as well. We just needed to have someone come out and fix our dryer. He came out but said that he didn't have the thermostat but we still had to pay him the full amount. We did and he did show up the next day to install the thermostat, the problem is, that our dryer is still not working. It's like nothing ever happened and when we call, we do not get anyone on the phone, just a message. We have left numerous messages, email, etc. but still no one is responding. My husband just went to the Frisco office location and there IS NO SUCH BUSINESS there. The UPS office told us they just rent a mailbox and that the guy is late on his payments and they are moving.

Getting the feeling this is a scam. I'm going to try to give them a day to make good on what they promise on their website - "guarantee all work and parts for a year".

Just an update: After never receiving any calls back or having anyone answer any phone calls, I decided to have my brother pull up intelligence history on the owner of the company. First, the BBB has the owner listed as "Don". The owner is Bernell Burton. His rap sheet is a mile long. He has had different companies listed such as K
