Toyhauler trailer can't be towed - Toyhauler trailer

My 22 year old son visited RV's for less to inquire about the size and type of toyhauler trailer he could tow with his Toyota Tacoma 4 x4 truck. He spent several hours with a salesman. The salesman at first considered selling my son a rather large trailer that obviously could not be towed by his truck. Saying that he would have to have it delivered because it would not be legal for them to let him drive off the lot with it but once he got home it would be no problem. My son replied that he only needed a small one to tow his quad to Pismo Beach, CA for weekend excursions. My son repeatedly asked which one could be easily towed by his type of truck.

The salesman assured him the the all new 2008 blast would easily tow with his Toyota Tacoma. They then proceeded to run my sons credit and preapprove him. Even though he told them he wouldn't have the down payment for 1 week. The next week when my son had his downpayment of 5,000 and returned to the dealership to make the purchase the serviceman helped him hook up the trailer and told him he would have no problem. However, when my son pulled out of the dealership he felt as though something was very wrong. His truck struggled to drive. He had to keep the gas peddle floored. The trailer brakes were not adjusted properly een though that was one ofthe things they supposedly took care of. He also couldn't see because they failed to sell him mirrors or inform him that he needed additional mirrors because his truck is narrower than the trailer. He came straight home about a half hour drive.

He came in and called the dealership and told them he could not tow the trailer. They insisted he should have no problem. The following day my husband and father towed the trailer back to the dealership and plead for 4 hours only to be ignored by the owner and pushed off from one person to another. Until they were wore out and returned home. The
final statement from them is that they can not undo the deal. which is a long term contract for over 15,000 for a trailer that he cannot pull with his one and only truck. We have since spoke with numerous other people who are more familiar with trailer/toyhaulers and all have expressed that the dealership was way out of line selling him that trailer for use with a Toyota Tacoma. We have even checked with other local dealerships who say they would not have sold that to him for safety and legal reasons. We have filed a complaint with the BBB.

We have a brand new trailer parked in front of our house that can not be used. My son is locked in to a long term loan for a misrepresented product that is useless to him. Please help us by getting this story out. I feel like my son was taken advantage of due to his youth and lack of experience. They used bad sales tactics by telling him his truck could tow the trailer. This is no less than what is often done to our senior citizens. This is abuse. Not only did they put my son at risk but also other drivers.

THERE IA A LAW IN EVERY STATE THAT IS CALLED MERCHANTABILITY LAW. IT MAY HAVE A DIFFERENT NAME IN CAL. THE LAW IS SIMPLE THAT THE PRODUCT MUST BE ABLED TO BE USED FOR IT'S INTENDED USE. IN THE CASE OF THIS TRAILER. EACH TRAILER SALES DEALERSHIP HAS GUIDES AS TO THE AVAILABILITY OF INTENDED USE BASED ON SAFETY AND WEIGHT OF THE TOWING VEHICLE. THE DEALERSHIP HAD A DUTY UNDER FEDERAL GUIDELINES TO IN FORM YOUR SON THE MINUMUN GUIDE LINE GVW TO TOW THIS TRAILER. IN MA THE LAW WOULD BE MGL93a FOR UNFAIR AND DECEPTIVE ACTS OR PACTICES. I SUGEST THAT YOU FIND OUT THE LAW OF CA REGARDING CUSTOMER FRAUD. THE OTHER THING IS YOU SHOULD FILE A COMPLAINT WITH THE LICENSING AUTHORITY IN THAT AREA. THE BBB REALY DOESN'T DO ANYTHING TO HELP. ALSO YOU SHOULD FILE A COMPLAINT WITH THE TRAILER MANUFACTURER. GOOD LUCK.
