To Whom It May Concern
I need some help; I was in a modification trail period with Indy Mac Bank. This took over 2 years to get. I made my first payment in July and they sold my house right from under me, this was within two weeks after I signed the trial period loan modification agreement.
For three months now we have been going back and forth with what I thought the bank kept telling me they were going to fix the issue not to worry, the bank (Indy Mac) kept telling me they do not know how this happened.
I had a 3rd party representative now known as the Law Office OF Oscar Acevedo which was formally known as 911. I have been making monthly payments in the amount of $300.00 dollars faithfully, I have paid totally approximately $7,600.00 this represent 2 years that they where suppose to represent me; this was up to the modification which stopped in July 2010, no payments for 3 months.
The bank sold my house right after I made my first trial period payment, then they returned the payment stating let’s wait until we get this straightened out before you send your next payment. I have been working with the Law Offices of Oscar Acevedo with the bank to settle this matter, but both the bank and my 3rd party representative have just been sending me through endless loops of no resolution in sight.
My 3rd party representative is now trying to send me out somewhere else, because they themselves do not have answers, but now they are requesting for payment again of $300.00 monthly.
I have given the bank and my 3rd party representative everything that was asked of me initially to get the loan modification; I am not sure where this fell through the cracks neither party is giving me straight answers. I myself called the bank (Indy Mac) to follow-up and I was told that they are going to contact the sheriff’s department so they can serve me vacate the premises warrant; I am trespassing in my own home.
My mother who is ill is living in this home with me and several other relatives, she is old and ill we have lived here in this house for over 3 years now. I have put a lot of time and efforts in making this place for me and my relatives our home a place of love and security, I am not willing to give up just like that.
I need some guidance in this matter I do not want to contact another organization just to be taken for a costly ride and string of endless heart breaks.
I tried initially to work with the bank myself and with no results is when I brought in 911 initially to represent me. Over the past two years this has taken a toll on my health and my family’s well being. I am so distraught of what if anything can be done, where do I turn to, and who can I trust.
I am not looking for a handout but a hand up in the right direction of what the next step should be.
