On August 10, 2010 I purchased a pair of Miracle-Ear hearing aids for $4,390 from the franchise located in Demorest Georgia, owned by Johnny Guest. The contract contained a 30 day return/full refund guarantee. I received the hearing aids on September 28, 2010. From the start they did not work properly. I went back to the Demorest office on October 5, 2010 for adjustment and a new audiologist told me the type of aide was incorrect for my level of hearing loss. The adjustments did not work and I notified the office on October 7, 2010 (nine days after receiving the aids) that I wanted to return the hearings aids for a full refund. After numerous communication and scheduling delays by the office (primarily Johnny Guest) a return date was set for October 26, 2010 when Mr. Guest could be there. The aids were returned on that date and I signed a form saying that I would receive a refund of $4,390 (Mr. Guest never did show up, meaning the return could have taken place much sooner, even on the 7th). Since that time there has been nothing but delays, excuses, broken promises, and outright lies, and I have yet to receive a refund. I have investigated legal action only to find that while I would Win the case the courts could not force Johnny Quest to refund my money. In November 2010 I filed a complaint with the Georgia State Licensing Board and a second one in December (having heard nothing from the first complaint). In December 2010 I filed a complaint with Miracle-Ear’s consumer affairs department. I have followed up both complaints vigorously, as well as made continuous effort directly with Johnny Guest, both by phone and written correspondence, but nearly nine months later I have still not received the refund. All parties have acknowledged I am owed the refund, yet the refund goes unpaid. Johnny Guest continues to sell hearing aides enriching both himself and Miracle-Ear, and in my opinion endangering the public to more of what I have had to face. I believe this story needs to be told.
