I had an accident with one of Progressive's insured. I was driving straight in my lane when an SUV hit the driver's side of my car and sent me into a telephone pole. I spent the night in the hospital. This man claims on his statement that I was riding the shoulder. I was never in the shoulder...I never left my lane. There was a witness, though. She said he was talking on his cell phone, didn't see me until the last minute and tried to jerk the car back but it was too late...he had already hit me. I consulted with an attorney because I knew that him claiming I was in the shoulder might be a problem for me. The attorney said to write a letter to the witness asking her if I was ever in the shoulder at all. She wrote back to me stating I was never in the shoulder...I couldn't have been in the shoulder because there were cars parked there. So I had all the evidence I needed, right? Nope...Progressive took his word for it, not caring about anything the witness had to say, not even taking into consideration that he was on his cell phone, and closed my claim only six weeks after the accident, even after the adjustor at Progressive told me liability was in my favor. At least my insurance company, Geico, does not find me at fault! I didn't have collision on the car because it wasn't worth it, so unfortunately, Progressive was the only way to get the money for my car...and they should've given it to me. Now I have no car, no money for my car because it was totalled, and this man gets away with everything!
