Please take a moment to read this letter. It will open your eyes to the everyday reality of thousands of our fellow citizens. I am referring to the Obama's Home Affordability Program and the way it is not working. We call this letter is Chapter III in my story.
It all began at the end with me losing my job and seeking help from the bank though Home Affordable Program. We filled out the appropriate paperwork, submitted proper documentation, faxed it to various numbers, hundreds of phone calls later, hundreds of lost communications later I was finally told we qualified. No contract ever arrived. No payments were ever withdrawn; in the meantime, once again, I kept on making phone calls, sending faxes, letters etc… I have gotten so many conflicting stories from different bank employees, my head is spinning. I am attaching some history for your review with this letter, because retelling the story once again in this one would take up several pages…
Chapter I: We have written a letter to President Barack Obama on Oct 10 2010 with the details of our sad story and how his Home Affordable Program paid with the money of taxpayers’ did not work for the American families (please see the attached letter). We were hoping that someone would at least reply to us with a courtesy acknowledgement but have not heard anything to the date.
Chapter II: After 2 month of no notice from the White House, not even a courtesy letter, we send a certified folder to the Senator of Colorado Michael Bennett dated Dec. 10 2010 (please see attached). I have explained the situation, attached copies of all of the payments, dates, our conversations with the bank etc. And once again, we have not gotten any sort of a reply from anyone in his administration or any other appropriate agency.
We, the citizens of this country, have been faithfully paying our taxes and contributing to this country’s wealth and greatness. I also feel that we, the hardworking citizens of this country, have helped the banks recover from the financial meltdown.
After we realized no reply would be forthcoming, we have decided to post our story Chapters on the internet for all to see. And I got flooded with the emails and the phone calls from people who are in the same desperate situation with the same bank – Chase. These people also have not gotten any resolution to their problems, have not been heard and were about to lose their homes.
The United States government's (Homeland Security)
National threat level is elevated or yellow and for all domestic and international flights, the U.S. threat level is High, or Orange. And is working on protecting our citizens from the external attack; however, no one is paying attention to the attack from banks like Chase that are terrorizing the lives of thousands of our hardworking American families internally. We think the national threat level shut be High or Orange for this matter.
Going back to us: we have been paying our mortgage payments monthly. Last night (Jan 29 2010), we have received our check from the Chase bank not cashed with the letter advising us that we are formally in foreclosure. We are willing to fight for our home but it is truly unfair that we the little people with very few resources have to go up against the wealthy and corrupt banks and no one is willing to help us in our plight.

If our story was unique and represented a single occurrence that would be ok, but bankers.
I hope that once you read this letter, someone would be willing to at least notify us of its receipt with the courtesy note.

Dear Mr. President,
We hope you will be able to read this letter, we understand that there several filters for security reasons. We represent millions of Americans that have hope in your Affordable Homes Program. In theory, when you explained the program, it sounded really hopeful in this economy. But we are not sure if these were just words or someone who is supposed to be implementing this program for you are not fulfilling their duties.
Our case is one of many we hear daily about regarding how your program did not work. In July of 2009, we sent all of the required paperwork to the Program Making Home Affordable Chase Bank in order to take advantage of the program. Nothing was said to me as far as the timeline of when I would hear back with some sort of results. Since then, I have been on the phone with Chase Bank representatives (they call them specialists) with zero results. Last November of 2009, finally someone told us that they have not received any of our documentation and there was no record of any of my conversations with the bank….Right then and there she has arranged for a quick interview and said I qualified for the program. She has said that I was ready to enter a trial period of three months but I had to resubmit all of the paperwork that has already been previously submitted by me.
I have kept calling every week or two to check on the status of the process with no resolution. In the meantime, they kept asking us for copies of our 2009 tax returns even thought they had a signed authorization to check with IRS. I have faxed those taxes at least 10 to 12 times to the Bank and each time I called to check with the bank and got a positive answers from the people on the phone, yes we got the taxes and every thing it’s ok.
In the meantime, the time has passed by, I kept calling every week, in June of 2010 I received a letter that we didn’t qualify for the program (!!!)(????).
Mr. President, you have no idea what the level of my family’s frustration levels are. I called again and spoke with another “specialist” - Mike, who said that he doesn’t understand why the denial letter was received by us because he saw in his “system” we are in the program. That was very exciting. Mike made my day. Several days later, at the end of June, we finally got the contract.
They were going to reduce our payment from $1064 to $850. The contract explained that for seven years, the payments were going to be fixed at $850 and subsequently would go up but not to the original level of payment.
We were telling our friends that the President’s program works, and that it was worth keeping up communication with the Bank no matter how frustrating the process was. Each time I called, it took me up to an hour to get through to someone.
The Bank advised us that our first payment was to be August 5th and we signed the direct deposit contract. I kept calling the entire time to check on the contract status as we never received a copy from the bank. Each time we called, we were told, we are approved, please do not worry about this, you are approved.
The problem arose when our funds were not taken out of our account for the mortgage payment.
October 1st, no money was taken out either, we called and checked - once again were told no worries, we were approved. There was an envelope received in September 7th - turned out that Mr. President, there a different contract in it. It said that we were approved, but our payments were going to go UP from $1064 (original payment) to $1071. I called once again; they told me that there was a mistake in their “system”. They said that because I filed Bankruptcy in 2008, the bank had to hire a lawyer to take me out of the bankruptcy status, that’s why my payments were going to be MORE. I asked whether I had a choice, they said no. What a joke!
Mr. President, I told this “specialist” that someone is making our President look like a big cloud. Because what you say and what the Home Affordable Refinance Program
Is doing are two complete different things. That is the reason why we are writing this letter. This is my last hope to have justice. We are not the only people in this boat. My friends tried discouraging me from writing. But we feel that it is our duty to inform you what American Families are going through on a daily basis. Since this is a really long story, we are going to give you some time to assign someone to our case so you can see all the details and provide you with a power of attorney so that they can go into our account to read the entire story.
I know that they have all the “record”, as each time I called someone confirmed the notes from the previous conversation and also you will find the entire document and the two contracts that they send us.
Mr. President, we did vote for you. We never thought that you could personally help us but because we thought you were the right person to lead the American people.
I hope you’ll find the time to look into this letter and don’t take this personally, this is what we, and the hardworking American people are going through.

We hope you will be able to read this letter. We represent thousands of Colorado residents that have hope in The Affordable Homes Program. In theory, when President Obama explained the program, it sounded really hopeful in this economy. She has said that we were ready to enter a trial period of three months (we make 8 payments on time of trial Nov thru June #1) but we had to resubmit all of the paperwork that has already been previously submitted by us.
On December of 2009, we received a letter said the trail payment has not been received. We did paid by phone on December 10th; we kept receiving this type of letter and if you see we did paid on time all the trial period. (Copies attached #2).
We have kept calling every week or two to check on the status of the process with no resolution. In the meantime, they kept asking us for copies of our 2009 tax returns even thought they had a signed authorization to check with IRS. On July 15th, the bank cashed the check of $ 818.82 that we send with the contract, the call a quick payment (copies attached #5) and they advised us that our “first payment” was to be August 5th. We signed the direct deposit for the new contract ($ 818.82) it was established in the contract.
We kept calling the entire time to check on the contract status as we never received a copy of the new contract from the bank. Each time we called, we were told, we were approved: “please do not worry about this, you are in the program” now your first payment is going to be September 5th.

On September 7th there was an envelope received by us - turned out, Mr. Senator, there was a same contract with different numbers (copies attached #6). Now our payments were going to go up from $1068.66 (original payment) to $1071. We called once again; they told us that there was a mistake in their “system”. We call Chase and asked whether we had a choice, they said no. What a joke! (Our economic situation was and still the same) We didn’t sign the second contract.
Chase kept sending us bills for $1067.99 (the trial amount), each time we paid on time November, December (copies attached #7).
On December 9th of 2010, the day of our 32nd wedding anniversary, we got 8 certified letters and others 8 letters in the regular mail (copies attached #8), said that we were in default because we failed to pay the required monthly payment since 03/01/2010. And if we don’t, pay within 32 days of this notice, Chase will accelerate the maturity of the loan. We are attaching copies of all the payments in 2010(copies attached #9) only 3 payments are Missing: August, September and October, this are the payments that Chase was supposed to take from our account, but the took July’s payment (direct deposit $818.82) as per their initial instructions.
Mr. Senator, this is our last hope to have justice. We are not the only people in this boat. But we feel that it is our duty to inform you what American Families are going through on a daily basis.
As you know the banks are hiring people with no experience and they give no training at all. And we the people are paying all the consequences.
We are so tired of all this“game”the Chase as be playing with us for almost 2 years. Please Help Us!! All this process has been a torture, the stress is killing us, we don’t know if tomorrow we going to have our house. 'We Don't Want To Give Up! All this time we did everything Chase told us to do, we send all the papers every time the ask for it, we didn't miss any payments in this long period of the trial. We Don't Know What Else To Do?
Since this is a really long story, we can send you a power of attorney for our Chase account so you can see the entire detail.
We know that they have all the “records”, as each time we called, we asked to confirmed the notes from the previous conversation and you will also find all of the document and the two contracts that they sent us.

This is a follow up on the letter I mailed to your office on December 10, 2010. I am attaching the original letter for your review.
The latest is that we have been faithfully sending our mortgage payments to Chase bank and we are going to attach copies of cashed payments within this letter.(copies attached #11) January 5th, 2011 I went to the local Chase bank to make my mortgage payment and was not they will not accept it. One the bank’s employees (Jade R. Pardo) offered us her assistance to try and figure out what’s going on. She spent at least an hour talking to me, going over my records and finally called her corporate office. The corporate office advised her that the reason everyone went wrong was because the Home Affordable Contract ($818.82) was missing my wife’s signature and that the contract was returned to us for that additional signature (it never was) and we were never notified of that be phone once although we kept calling to check on the status of the contract every other week and they kept said “please do not worry about this, you are in the program”
Jade asked the corporate office what we needed to do now to fix the situation, she was told to have us mail in our mortgage payment and start the application process from scratch. This was highly frustrating but we agreed. I mailed it a check and to my amusement got it back in the mail last night (Jan 29 2010) not cashed. The letter that was attached to it, said that the check was being returned due to the fact that our home was in Foreclosure (???!!!)
