Encore Credit Corporation Lender, went out of business, during that time the servicer changed to Option One Mortgage Serving, then I was informed they went out of business, then EMC ended up being the servicer. 2006 to 2007 is when this occurred. MERS assigned the loan to the trustee Fidelity National Title, and La Salle bank / Bank of America was the investor on MERS system of my research. They tried to foreclose of me and I filled bankruptcy and got a stay. For the last 3 years I have been trying to get a loan mod. They turned me down and started again three times, then I did a forensic audit and found that it was a predatory loan and TILA violations, I received title copy of my docs. my 1-4 rider were forged with my signature and initials. Many docs were missing. EMC claims that Encore Credit Corporation still has the note. They do not exist under that name. I do have many finding where they went and who they are now. I have two title companies stating two different things on title so I am requesting another from my title company to see if I can resolve this. By MERS assigning the note and not owning the note to assign and forgery nullifies my mortgage and since they went out of business I need resolve and get my money back from EMC including my down payment etc. They are paying my taxes and they can make a adjustment for that and I have requested them not to make my tax payment and insurance anymore.
I have made a Fair Housing Complaint through an Advocate and have had no response. I have been preyed upon.
As of now it is their Loan Integrity Fraud Dept. and have not heard back from then in 7 days, as of today. EMC has approved the 3 month trial again in June 1 2011 but I told them to put it on hold. They have gone through HAMP on a predatory perjured loan and now they Know it. Do you have a method of payment through Law Suit on a winning case / I have spent lots of money on this so far and need some help if you could some how. I have also informed the FTC and Darrel Issa congressmen and California Attorney Generals Office.
