Positive Changes Turned Into Negative - Hypnosis Centers

After having a discussion with the owner of this franchise about discontinuing my 9-mo contract of which I paid $3,700 up front, because I felt "their" program was not working for me, she insisted that I give her office another chance if that meant one-on-one meetings with her, of which I agreed to and kept all of my appointments that were scheduled in advance. About three weeks later, she informed me they would be moving their facility to another city and said she would apprise me of the details. Having kept one more appt with a phone visit, the therapist told me to call and make other appts the next day. Three or so weeks later, the owner e-mailed me explaining that the facility was "shut down" by corporate. She explained that this was not her doing and she knew nothing of this at the time she told me about the move in mid-February. She wants me to continue coming to her classes (without hypnosis sessions)and said she does not have a penny to reimburse anyone. She is broke.

Well, come to find out I looked at the court filings and found out that she had filed complaints in Federal court against her franchiser in January '08 and again in February '08, for almost $100,000!!!!!!!!!

I have other info that Positive Changes shut down other franchisees at a moment's notice in other multiple states as well, leaving people with NO NOTICE.

I am a victim of fraud -- no prior formal written notice! Shut down and then call!! She must have had an idea when I signed on in mid-October '07 that she was having trouble meeting her financial obligations and complained more than once that she had high overhead. I was hypnotized during the consultation which left a slight euphoria to definitely make me feel that this would be a "positive change" to losing weight in order to keep me "positive" about signing a contract. Well, coupled with her dishonesty, I do not think she gets a third chance of my time..... and money. Yes, a class-action suit would be great because small claims court would not be of benefit to me!
