In June, 2006, my former wife and I, in an attempt to reunite, purchased a residence in Brownstown Mi. In less than four months there, it became necessary to have our roof replaced (COST....$5,000). A major sewer break in our plumbing system occurred (COST....$12,000). In an attempt to have our basement water-proofed, we contracted one "MIDWEST WATERPROOFING OF WYANDOTTE", to perform the work. Their charge, $7,000. It was agreed they would do this work for us. We gave them a check for $2,000 to start, and, two days later, they came to our house to start the work.
When the four workers arrived 1 1/2 hours late, I noticed the very strong smell of alcohol from one of them. As they had just arrived, and, did actually no work, they were told to stop working, as I wished to call to talk to the owner of the business. After three calls, he finally came out to our home. He was very loud and abusive to one of his employees, and swore at him as he chased him down our street calling him names. With this I called the Police. Within minutes, the police arrived, and, I told the business owner that I did not want him to continue with the waterproofing job, and, to leave my property, which he did.
When we tried to retrieve the $2,000 check, we were given lots of reasons when we would get it. We never did get it. About one month later, our lawyer advised us to take the Company's owner to small claims court for our $2,000. We were instructed by a clerk at the local court, that it would cost us some $63.00 to start the procedure to get our money back. That money was paid, but, when the court tried to contact the business owner at "MIDWEST", he never accepted any of the letters sent by the court. It was determined that the owner of "MIDWEST" can't or couldn't get building permits, so he sub-contracted the work out to one "CHICUTT PLUMBING OF WOODHAVEN", which was actually the ones to come out to do the work.
So, a clerk at the court advised us to go after this "chicutt plumbing". Another $65.00 was paid, and, attempts were made by a policeman (who was paid an amount) from the court to serve the owner of "CHICUTT PLUMBING". "CHICUTT PLUMBING" was served in a timely manner, and, when the court date came, "chicutt plumbing's" representative failed to appear, and, the judge awarded us our $2,000 plus our costs involved. Approximately 7-10 days later, AFTER THE JUDGE'S RULING IN OUR FAVOR, my former wife was contacted by some lawyer. As it turned out, the JUDGE'S ORIGINAL RULING IN OUR FAVOR WAS OVERTURNED,BY THE IDENTICAL SAME JUDGE) and, my former wife had to go back to court, at which time she was told that she/we had lost, and, we would not be getting our money after-all!!!!
THIS WHOLE MESS HAS TAKEN ALMOST ONE YEAR(from Sept. 2006, until July 2007). In good faith, we paid this $2,000 to get started on this waterproofing job, and, now we have lost over $2,200.
Over and above that, all the worry and trouble we went through, it just doesn't seem fair. MY FORMER WIFE AND I BOTH ARE IN OUR SIXTIES.
