Losing house after making payments on time... - Mortgage

We were with Country Wide Mortgage company and B of A bought our loan. Ever since they took over we have been considered late with all of our payments. We make our payment bi-monthly, the 1st and the 15th. When we were with Country Wide, we were two week ahead with our payments just in case the 15th landed on the weekend and the money didn't come out of our account on time. B of A has held onto our payments for up to as many as 19 days, before adding them to our account, and of course we have been charged late fees. We have tried everything we can think of to get this problem fixed. We have of course been in touch with Customer service with B of A and their Office of the President and Ceo. They say they will fix the issue and change things around on our account. But for some reason we are still almost $7000.00 in late fees.
We have been in touch with the OCC. But that has done no good either. We even talked to a lawyer, and have been told in so many words, just pay it because we would spend more money fighting them in court.
We recently talked with their modification dept. They were supose to find out exactly what is going on with our account, if they actually did make a mistake or if we really do owe some late fees. For two years now we have tried to sit down with someone who would listen and try to help fix the situation so we can make our payments without late fees, but they keep putting us off and claiming they have not been able to get the information they need to fix this. We can't refinance because our credit is soo messed up. Can you help????? Bob and Sandy Russell
