We could not make settlement on a new build (spec house)in Delaware due to a serious accident I suffered on August 24,2008, 5 days before our settlement date of August 29,2008, and extended to October 2008. I was hospitalized with a Spinal Chord Injury in intensive care after fusions for 9 weeks. I am still recovering with therapy from an Incomplete Spinal Chord Injury. I was released from the hospital on November 1, 2008.
K Hovnanian homes of Delaware, L. L.C. (“Seller”) kept our earnest money deposit of $32,000 and sold the home in March 2009 for a lesser amount than we were to purchase the home at.
In December 2008, the Delaware president stated Khovanian would try to sell our home, and we would pay penalties and recapture some of our monies. Now we have no response. Our finances have decreased, since I had to retire due to health, and now on pension.
It seems unjust that we are double punished for this unforeseen accident
