Statement of Events
On April 11, 2010 my husband & I visited K & D furniture located at 15315 Tamarack Rd., Victorville, CA. We spoke with Jerry Withrow regarding purchasing two different sofa sectionals 1) 4 piece Papasan Sofa, by Yalus 2) 2 Piece goose down with a 2 arm chaise and 2 ottomans. We negotiated a cash price and scheduled an appointment for the following day to complete the transaction. On April 12, 2010 we paid with a cashiers check from Arrowhead Credit Union in the amount of $2600.00, which was the cash amount agreed upon.
It’s was agreed that the Papasan Sofa would be delivered within 2 weeks from April 12, 2010 and that the goose down would be delivered six weeks from April 18, 2010 the prior week of April 12, 2010 was used to order the materials need by the manufacture of the goose down. Per receipt furniture were to be delivered as they came into from vendors.
We have made repeated calls to both Jerry Withrow and Debbie Palmer for an update of the deliver status of sofas at the following numbers 760 269-0191 and 760 912-8388 requesting a call back with update on furniture. No reponse as of this date. On June 6, 2010 we finally went over the business location and found the location was now empty with a sign posted on door and windows referring customers to the following phone number 760 605-8163. The number is for a Perez family unfamiliar with K & D Furniture or Jerry Withrow or Debbie Palmer.
