In February 2011, I purchased a brand new 2010 Checkmate ZT 244 boat and Phoenix boat trailer as advertised and implied from the Boat Dock Marine Group P. O. Box 30 Southmont, NC 27351. Upon inspection of the boat there were many areas of concerns with the boat and trailer that needed repaired or replaced (Photos of damaged boat items submitted). I was assured by the CEO, and salesman, the boat would have all repairs made and once completed would look as if it just came of the factory floor in brand new condition. I was also assured the trailer, which has a dent in one of the fenders, scratched deeply into the metal and rusting (Photos of damaged trailer submitted) would be fixed before the boat was delivered to Ohio, It was not.

During negotiations of the boat sale I compiled a list of repairs I requested to be made and was advised they would be made (submitted email correspondence stating such repairs would be made). I was advised by the CEO and Salesman in a verbal agreement (Wife: witness) that they would have the boat delivered to Checkmate Powerboats in Bucyrus Ohio where the boat was manufactured to have all warranty repairs completed. (Submitted email correspondence containing a list of items requested to be fixed and or replaced). Being from Ohio myself this was one of the “main” reasons we purchased the boat from out of state because I was advised By the Boat Dock Marine Groups CEO, and salesman if any additional warranty work would need completed in the future it could be done through Checkmate Powerboats, only a two hour drive for me from my place of residence.

The boat was delivered to Checkmate Powerboats in Bucyrus Ohio by the CEO during the month of December, 2010. Upon delivery of the boat to Ohio, CEO of Checkmate Powerboats and his general manager advised me the boat was delivered to their plant uncovered through the rain and snow and salt. The boat was saturated inside and out with water, snow and salt which is believed to have contributed to the boats already damaged upholstery, Gel coat and marine gauges. The Boat Dock Marine Group CEO told me he trailer the boat to Ohio uncovered because he didn’t want to tear up the boats cockpit cover. (Submitted email correspondence and invoice/receipt for new boat cover). The cockpit cover was already torn in several areas and no longer repels water. I have requested numerous times for a replacement to no avail. Also, Checkmate Powerboats, general manager said they never received the list of repairs from the Boat Dock Marine Group I submitted for repairs.

In the exact words of Checkmate Powerboats CEO, the boat has been “Dealer abused.” (Phone message left on recorder)

Some warranty work was completed by Checkmate Powerboats under their warranty. However, Checkmate Powerboats would not warranty any repairs they contributed to dealer neglect or abuse. I, the customer have paid out of pocket for approximately 95% of all repair work needed. (Submitted invoices/receipts/estimates for repair work completed thus far or still needs completed).

As of this date I have spent approximately $2000 dollars in order to have the boat repaired. It will total approximately $4000 dollars when all repairs are complete according to estimates received from the original manufactures of the items in need of repair. I believe all of the boats repairs should be covered under the boats warranty (See attached Checkmate Powerboats manufacture warranty) at the expense of Boat Dock Marine Group and not mine.

I have tried numerous times at negotiating a settlement for expenses accrued on my behalf and for warranty work that still needs completed by the Boat Dock Marine Group to no avail. As stated by Boat Dock Marine Group salesman in a recent email…“you got that boat next to nothing, we took a big hit on that boat.” (Submitted email correspondences). Boat Dock Marine Group will not answer or return my phone calls or emails when I simply just want to be reimbursed for my out of pocket expenses and to have the remaining repair work completed by the original manufactures.

The CEO of Boat Dock Marine Group states he will make all legitimate repairs that the boat needs (submitted email correspondences) but now all of the sudden wants the boat to be hauled back to North Carolina for repairs. Most of all the repairs have already been completed by the original manufactures; I’ve just had to pay for them.

I am requesting FULL reimbursement for expenses paid for warranty issues paid by myself to date and for future expenses of repairs still yet to be completed. (Submitted paid invoices and estimates for warranty work still needing completed).

At this point, I believe the only items that still need to be fixed or replaced are.
1.Dented scratched boat trailer (submitted estimate for repair and Photos).
2.Sun pad faded vinyl upholstery, saturated with water and pink mold growing inside the vinyl upholstery that needs completely re-skinned (estimates submitted by Checkmate powerboats and photos of damaged items).
