In 2007 I was notified by EDD that I was going to be levied for a job I worked for in 2004/2005 for Big Lots. EDD said I didn't file forms showing that I made money so they over paid me 492.00. The levy was sent to a wrong address a type o and so I had three days to answer their levy (not enought time)
Since I'm a state worker myself, they took out a 1000.00 in two checks before I could see a judge, in which my payments were $80.00 a month, in which I receive the money back. However EDD said they didn't get their money, the Shrieff office said they didn't have it, but DMV said they sent it. Two months later the Shrieff Office said DMV put the wrong case number. EDD said they were charging me interest for the mess up and did. In the mean time now 6 months later. I have asked for copies of all my claim forms from 2004 to 2007 including waiting periods in which I called and claimed money, but not enough therefore still elible for benefits. I've done spread sheets, made calls after calls, letters, when finally I talked to a Mr. Stevenson, who said to talk to the Security Dept at EDD and that they would help me. I call and talked to April who wouldn't give me the security dept, who said she would help but then called and said they only keep records for three years. What? So I said April you are Levying me past the three years and you don't have records? Yes! If I were you I would just pay the levy. Well I am paying the levy but I would I'd like my records to audit myself. You see I know I filled out the form. It could of had the wrong year as right around that time I won an appeal which took EDD a year to pay out and so I had to fill out claim forms for that year plus BIG Lots. I want those claim forms and any waiting period along with phone interviews by EDD. I can't believe EDD only keeps claim forms for three years. Why? Because Mr. Stevenson pull my records up FAST he said he would send them to me but had to ask....thus the Security Dept. I need help.....I'm exhausted trying to go through the maze of lies and wait times with EDD. Its a government agency they keep files forever like the IRS....ya know. But EDD likes to pass the buck and I'm sick of it.
