My lease on my truck ended in August 2010. I called for payoff amount to purchase my truck, submitted a certified check for the total amount. The check was cashed by GMAC. I receive a phone call in Sept that they cannot send me my title until I get an open recall on the vehicle fixed. I have MS...I was not feeling well and didn't mind waiting for my title. On November 4th 2010, I receive via Fed Ex a check from Ally financial for $36,500. I call and am told that they cannot sell me my vehicle because of the open recall and I must get it fixed and resubmit the funds. I had an extremely important personal matter I was dealing with and did not immediately get my truck to the dealer for repair. I called for an appt and the soonest appt was a week out. I called GMAC informed them of this and was told it was not a problem and "whatever you do don't cash our check" which I did not. My truck was fixed on November 23rd 2 days before Thanksgiving. On December 3rd my neighbor knocked on my door to tell me someone was pulling away with my truck. Now they are reposessing my truck mind you I still did NOT cash their check so they are now in control of the money & my truck. I immediately went to the bank and deposited the check. When I called them I was told I did not get the truck fixed in a timely matter. Are you kidding me??? Within a month I'd say ample time!!! My husband passed away 2 years ago, I am a widow with 3 young children and I also battle MS. I cannot just drop what I am doing because GMAC says so. I had my truck fixed in ample time, They should not have given me a buy out amount if they couldn't sell me the truck. Once they realized THEIR mistake, they should have given me time to address the matter. I was so angry I told them to keep my truck I do not want it. I was then told I would be held accountable for fees and xcess mileage since the lease was up in August.....this is ludicrous!!!!!!! I should not have been subject to the humiliation I faced in front of my neighbors. I did the right thing, I DO NOT want the truck...the last thing I want to do is give this company my money. Their business practices are terrible!!!!!!!!!!!!!!!!! Also to mention it will now take 5-7 days for their check to me to clear. That means I am without a car until then. I am absolutely infuriated by this!!!!!! I have made it a point not to rely on anyone through all the things that have happened to me & my children over the passed 2 years and now because of GMAC I have to get rides for us whenever we need to go somewhere. This is taking an emotional toll on me!!!!!!!! I want it known how these people do business!!! Being that I didn't cash their check, per their instruction as far as I'm concerned....they stole MY truck!!!
