On July 22, 1975, Ila Rhea Thomason/Hooder/Gray went to the Abstactor's Office to Deed 1.5 acres to her son and his wife to build a house just as land to build a house had been deeded to the first born son(12 years older)and his wife years before.
The Abstractor, Clyde B. Lyon, Notary Public, who knew every inch of Calhoun County drew up the Warranty Deed and had it filed and recorded by Joe Fred McDonald, County Clerk.
The very rigid rules of a USDA-FmHA real estate mortgage were well known to Mr Lyon. The St. Paul Title Insurance Corp by C. B. Lyon Agent were the first two lines of the preparer's statement on the Form FmHA 427-1 AR (Rev. 9-23-74). This statement on 10-9-1975 included the land description and was stamped with the seal of C. B. Lyon, Notary Public and filed and recorded as MTG# 7441 and recorded in: Book 3-E, Page 313 on 10-09-1975. Mr Lyon made sure to explain why he used the specific wording of JsonII Hooder and Lillian O Hooder to be legal and firm of the ownership or repayment responsibility if one of died.
John died in June, 2001. and I used all of the life insurance money to pay the mortgage in full and repair long delayed repair on the house.
Never at any time did any of these people with knowledge speak up and say there was a problem with the deed because John's father had died before his mother deeded the place to build a house. GsonI, JsonII's brother knew the land had been promised long before when he built his house but did not say anything until after JsonII's death.
He never paid taxes, house payments, utilities, or insurance on the property he knew should have been cleared up at the time the deed was made. He helped build a storage shed in 1983 past the property line insisting it was okay to build over the line just as he had done on the land that joined his 1.2 acres. We paid taxes and insurance on the building he never helped to complete because JsonII had already helped him complete the storage shed over the property line on the 1.2 acres he had.
He kept his brother close to be a slave to his business dirty work and heavy deliveries while I kept my mouth shut for family loyalty. He did not speak to him for years because he refused after the second heart attack to pick up heavy furniture that week. I kept my mouth shut about his under reporting to the state sales tax and IRS because of family. My girls were sucked in by his family speech as he got the antique coin collection and burned his mother's will in front of them to kick out his step father of 32 years even before his mother died. I kept my mouth shut and lost a job I loved trying to take care of them every hour I was not at work. I kept my mouth shut when he tried to force his mother into a nursing home.
Finally, after having a stroke, my daughter's saw his full vengeance when I went to lawyer Tmafia to clear up the deed problem. Tmafia said he could not settle one part without partition of the his mother's house and the remaining acres.
My mail box of 20+ years was ripped off the post and deposited at my door. The PostnoodleMaster said,"Well there's not really anything we can do about it". My bank statements, credit card bills, and other important mail went missing when I filed a change of address form. My car had the taillight shot out by the boys hunting deer out of the open windows in his mother's house and still I wanted to return to the home I had worked so hard for.
Well, the homeowner's insurance was canceled because "Someone told FBU no one had lived there in years". My homestead exemption was canceled because I was not there all the time after my stroke but if I had shacked up with someone at their house I could have kept it.
I was informed by the abstract company at Camden that I do not own anything. It belongs to my daughters, 1/4 each and GsonI.
Okay, my mouth is no longer quiet and if they burn it because I cannot stay there, I can't sell it because I don't own it and wasted $75,000 life insurance on a place the Realtor priced less than the doublewide up the road it must be a sign.
