Subject: Fraud, cheating and misguiding for the sale of 2008 Nissan Altima.
Dear Mr. DeLarosa,
On the morning of 6-13-2011 we were searching for the used Nissan Altima (2008, 2009 and 2010) under $ 18,000; we found the cars at Libertyville Nissan dealer ship ranging from $15,545 to $17,990. We called the liberty auto plaza for the Altima’s stocks # 9814, 20054A and 9756 all under 18,000 and asked for sales person named Fred, Fred was not there and other sales person checked those stocks cars and told us that dealer ship have those cars, also he asked what time you like to see the cars, we told the sales person that we be there around 12:30 right now is 10:20am.
My son and I went to the dealer ship on 6-13-2011 at 12:10 pm and was looking for Fred the sales person but he was not there and Steve introduced us with Diego who was standing by the door.
We gave all the stocks # to Diego and told him that we are looking for the used cars under 15,000 -17,990 and we have a 2011 Chevy HHR to trade, Diego asked us a lot of questions and then he took us out to look for the cars that we provide him with the stocks #.
We were going all-over the lot and could not find those cars which we saw on the web site of the Libertyville auto plaza, Diego said that those cars were sold, let me show you other cars at the same prices, we were surprise that dealer ship sold the cars within two hours, Diego showed us others cars and we test drove two cars and we chose the 2010 basic Altima which has 10k miles and we offered 18,000 for the car and asked for our trade in for the 17,000. We were going back and forth with the negotiation for the price, dealer ship management was showing on the paper only monthly payment range from 487- 397 with no down payment and confusing us big time, we asked the sales person Diego that the games you playing we don’t understand but, we specifically explained that we have only 13,500 to pay off to the bank for 2011 Chevy and 3,500 we need to pay off the credit card because we browed the down payment for the 2011Chevy, also we told the Diego and Frank that we can’t pay monthly payments over 280 per month while we were trying to leave the dealer ship, but Diego told us to look at the 2008 Nissan Altima which was just dropped by the leased customer. Diego said that we will match the price with that car, Diego said that this Altima didn’t go through certification, inspection and detailing yet but it will be all done later, Diego forced us to test drive the 2008 Altima which was just dropped off by the leased customer and Diego told us don’t worry about the condition and cleaning which will be taken care of later, and Diego promised us that he will work with the price of our range and wants to make a sale today, due to Diego’s and management promise we test drove the car around 1:45pm and then the negotiation started all over again, same monthly payments which we wouldn’t want to pay, we told Frank and Diego that if you pay the 3,500 check and pay off the Chevy $13,500 and keep the monthly payments under 280.00 per month then we take the car. From 2:15pm till 5:45pm we were going back and forth. Diego said Frank will work with the price and at 6pm finance manager came with some kind of white paper and wanted us to sign the paper, we looked at the paper and didn’t see the 3,500, then we told the manager that this is not right and missing the 3,500 what sales manager promised us, finance manager said that he doesn’t know about 3,500 but Frank is working with the price and I’m sure that he will take care of you whatever he promised to you and I’m just doing the bank work, then we singed the paper with the understanding that we will get the check of 3,500 later, meanwhile Diego changed the license plate from the Chevy to Altima and at 6:55pm we were getting tired because we spend the over six hours at the dealer ship we asked the Diego that it getting late, Diego said just 5 more min, the manager is still working with the banks for your finance, at 7:10pm Diego took us to finance office and we did sign a lot of papers and we stopped at last the paper because we did not see the return of 3,500 any ware on the ( retail order and invoice ) then, finance manager said he has no knowledge of 3,500 and went out to talk to sales manager Frank. Finance manager came back and said that Frank is out and you have to come back to finalize the sale tomorrow you could talk to the sale manager about 3,500. We were getting tired and wanted to take our car Chevy and go home but Diego said that he put our plates on the Altima and put some gas too, also Diego explained that the dealer ship did not have any loner cars and the service department is closed, just take the Altima, you are coming back tomorrow any way.
It was getting late and we were tired and we took the Altima. Around 8:40pm we called the dealer ship and talked to the manager Frank and raised the question for the check of 3,500, Frank said that you are coming back tomorrow I will take care you.
We couldn’t sleep and we went to dealer ship next day around 7:50am on 6-14-2011, and asked the cashier for the General Manager, she said he is out and will be back on Thursday. Around 8:55 Frank came in and he took us to the finance office and took out our file and said you were looking for the 280 per month and your car isn’t worth 17,000, we were in the total shock, we asked Frank that we like to take our Chevy back because paper work wasn’t done last night, Frank said that he sold the Chevy. We asked to talk to the other manager, Frank said GM will be back on Saturday you could come back Saturday, we asked to use the dealer ship’s phone, Frank said that you can’t use the phone just leave, we were insulted with the treatment we received from the management, before we left we told Frank that we will contact Nissan consumer afire, Frank replied whatever just leave.
At 10:30 on 6-14-2011 we filled the complaint to the Nissan consumer affairs, NCA created the file, # 7191614 and said that specialist will contact the general manager of Libertyville auto plaza to resolve the matter and will call us back also instruct us not to contact the dealer ship until this matter resolves, and instructed us to take the 2008 Altima to any Nissan dealer ship for an open recall of the faulty nut on the suspension which could be fatal in case if loses its position during the driving.
We were surprised that Libertyville auto dealer ship’s sales management was in hurry to sell the car without the inspection, certification and cleaning the car also break lights going on and head lights aren’t working properly, on the top of all of this, finance manager was pushing us to take the Nissan security plus warranty without certifying the 2008 Altima, which was just dropped by the leased customer hours before the sales paper work on 2008 Altima. Sales manager Frank took the chance on the life’s of the two customer to release the Altima without taking it to the inspection and certifying it.
Note: on 6-18-2011 we checked the Libertyville auto’s web site and found the Altima’s still advertise which Diego and Frank told us were sold on 6-13-2011, we are wondering what kind of a game Libertyville auto sales management playing with the innocent consumers like us!
