Eviction Notice for Senior Citizen Paying Same Month as Due - Apartment and Lease Agreement.HELP about to be evicted

- Indiana - 2425 Central Park Dr. S. #120, Plainfield, IN 46168
I am in the process of being evicted even though I am paying in the same month as rent due. Apartment rent due on 8/3/09 and paying on 8/26/09. I have rent money and late fees and water, but I am also being forced to pay Concession Loss for one month free rent at this same time also of $849.00....Total due by 9/3/09 is $2388.22....Lease Contract of 1/9/09 was not given to me until Aug. 09, nor were any statements sent out for rent until July 09. The Copy of the Concession Loss Addendum of this contract states this amount is due on Moveout, not at the same month in which you go over 10 days late in paying your rent. I am a Senior Citizen and I receive my first Social Security check on 8/26/09. I turned 62 in June. I could not get enough hours in May and June to be enough for the rent due in August 09. My pension from my retirement went down $1000.00 on July 1, 2009, due to early retirement from an airline of which I was employed 22 years. I have spoken to Elizabeth Spice at 317-839-9595 at this apartment office and her Regional Manager Gillian about this and they know I am paying the rent and late fees, water on 8/26/09. I have also a letter from their lawyer Mark Sidebottom dated Aug. 09. I called to speak to him today, 8/24/09, but he was not available and I spoke with a Cheri who would not give me her last name, stating she was the only Cheri in the office. She needed to speak with Mr. Sidebottom due to the difference in his eviction letter and the amount on my Balance Forward on my bill which I received 8/22/09 for total amount due by 9/3/09. I do not have the other $849.00 for the Concession Loss and I feel they are unfair and total disregard for their renters. I am so upset I am shaking.

All I can possibly have is on 8/26/09 a payment of $1100.00 and on 9/3/09 a payment of $900.00....that is a total of $2000.00...which is short $388.22. I guess that would put me into an eviction state again. I then have to also pay their attorney Mark Sidebottom about $160.00...for his service of beginning eviction.

I have all the documents that I have sent to the Indiana Attorney General's office as well.

Oh, also their lease contract states that you cannot obtain an attorney against them until 6 months after you move out. I could not afford one anyway.


Please help!

    Just Move to a cheaper place that you can afford, or share a apt with someone like you
