I was con into verbally agreeing on a franchise by Cuppy's Coffee and More base in Florida to build a store by there builder, Elite Manufacturing, LLC, who reside at the same address: 548 Mary Esther Cutoff Fort Walton Beach Florida. The catch was, Elite will pay the franchise fee of $25,000 if we put the required down of $37,900 to build the store, which we did. The UFOC franchise agreement was never send by Cuppy's to us, which is a clear violation of FTC. The builder contract clearly states that down payment will be return to purchaser if we can't get finance. When I asked for our down payment, Danny Jones @ 850-243-7021 Elite MFG representative say that it didn't say we have to return the down payment in full. We tried to fight it but we are short in cash so we enter into a Settlement Agreement that Elite will pay the down payment in 24 monthly installments if we drop our complaint from BBB and Florida Dept. of Agriculture, which we did, so we both agreed on the 24 monthly installments. To date, we still haven't received any of the payments.
Can you help us and other consumer that will do business with Elite manufacturing LLC, to have there contract change and clearly specify if down payment will be return in full or in monthly installments. We are pretty sure, that if the contract states that down payment will be return in monthly payments, we will not sign that contract.
