Dover Creek Builders, Inc. of Manakin Sabot, Virginia was contracted to construct a custom home. The contractor persuaded us to use him as he stated he had built over 1100 homes and did not need to work, but did it because he loved the industry. He stated that our home designs would be given to an engineer to assure all aspects of the construction were correct prior to beginning construction. The contractor abandoned the site after a lenghty 1.5 years leaving us with 37% completion of the construction with major structural defects in almost all aspects of the construction as well as engineering issues and code violations. The contractor also received 57% of the funds for the project from the bank, BB&T, with only 37% completion and has refused to respond to us as well as the attorney to account for where the money is. The contract was a cost plus type contract and as per the contract, the builder was supposed to supply us with monthly financial statements. None were supplied. We have worked our entire life to build our dream home for ourselves and our three children, the oldest with Down's Syndrome. We are left without enough money to correct the structural problems, much less the remainder of the construction.
Unfortunately, we are not rich, therefore, opting to pay out of pocket is not a possibility. We are currently living cramped on the adjacent parcel in a small home with no closets, one bathroom and approximately 1200 square feet of space which was only supposed to be temporary until the construction was complete. The initial contract was signed on 8/2/04 and as of today's date, we are still left with this nightmare!!!!!HELP!!! Please tell this story so that others will not fall for the salesman pitch that landed us in this position!!
