Just because they put it in writing and sign the contract doesn't mean they're going to fulfill their obligations as they promise to do. This complaint is in regards to Morris Timber Co. / Carl Rogers Logging / Billy Cooper Foreman / Matt Morris Company Owner. We agreed to terms and the contract presented that we'd let Morris Timber Co. thin the trees on our property. Everything we were told from the beginning to end has been so backwards it's unreal. Mr. Cooper knows how to make you feel all safe and secure and that everything is going to be taken care of, and then either half does it or just doesn't do it at all.
LIE #1: They insisted on using our private road which also leads to a cemetery on the property as the logging road instead of the location we wanted them to use because they'd have to build a road.. so instead they cut down our new barbed wire fence and proceeded to push the small trees and debris around and scooped the dirt from the embankment and set it so they could drive the equipment across it.. Billy Cooper verbally reassured us that the dirt would be put back, the fence would be put back in repair and you'd never know they were there. They left in March and we're still trying to get them out here to fix it as they promised to do.
LIE #2: We were told no tree tops would be left in the woods, there would be a delimber at the sets and all limbs would be in a pile on the set.. this didn't happen. The delimber wasn't brought out until later after the work had already begun and we were promised that everything would be taken care of with the tops that remained in the woods. Mr. Cooper was supposed to walk the job site when he came out ot oversee the Carl Rogers logging operation, which didn't happen. There are tree tops in a spring fed flowing creek that were supposed to be removed, they're still there. We had garbage such as gatorade bottles, oil jugs, oil filters, food cans & wrappers strewn about.
Upon (finally) the repair of the fence and fixing part of the drive we use as our entrance there is still dirt work that needs to be done to get the front of the property back in order. This should have been done before the fence went back up, but they're blaming that on us insisting the fence be done right then.. but we'd already personally stretched the old fence back up until the other work was to get done.. they took it down, left it and before the rest of the work could be completed the fence went back up. Failure to coordinate the dirt work / fence replacement is their fault, but they're blaming us..?? There are mounds of dirt and debris left and there needs to be a load of top soil dropped on the area and spread back around instead of these piles of debris and dirt. Mr. Cooper was aware of this but for the past 3 weeks cannot be reached by phone and won't return phone calls. Mr. Matt Morris, owner of the timber company says they're not going to do anything else because "they can't make us happy"... uh.. fix my property back like you promised and I'll be happy.
LIE#3: They widened our road that was currently on the property to access an area toward the back of the land.. they got some really big equipment stuck after a rain and instead of the driveable road that we once had, we have a rutted debris filled mess that looks like a grenade went off. They said they would get it fixed, hasn't happened and now they're not wanting to come back out and fix what they agreed and promised they'd do.
We had trees that should have been put on a truck but because the truck had already left instead of trying to put them on another truck they just ran them thru with a saw cut into short lengths and threw them aside..
The whole point of this is DO NOT TRUST THESE PEOPLE TO DO WHAT THEY SAY THEY'RE GOING TO DO. MORRIS TIMBER CO. COMES IN, TAKES YOUR TIMBER, TEARS YOUR LAND UP, LEAVES, THEN REFUSES TO HONOR THEIR CONTRACTUAL OBLIGATIONS, WHICH THEY THEMSELVES HAVE OBLIGATED THEMSELVES TO DO. IF YOU HEAR MORRIS TIMBER CO & CARL ROGERS LOGGING, RUN THE OTHER DIRECTION! We were told this was a reputable timber company and they've turned out to be anything but. I've filed a complaint with the BBB of Tyler and have also contacted my attorney. Mr. Morris wants to argue about arbitration, but he's not willing to meet us and see what needs to be done to finish this job. This "business" is a total JOKE.
