No Laws in South Florida to Prevent Condominium Boards from Practicing Fraudulen

After 20 plus roof leaks, my association refused to allow me to replace my own roof at my own expense, ignored reports from specialists indicating my roof was dangerous and needed to be replaced immediately and when I found out my home had toxic mold, refused to allow me to put through a claim according to statue 718.111, effective January, 2004 to replace the drywall in my home.

My neighor's was flooded as a direct result of the association's contractor putting on new roofs during hurricane season and not properly sealing the roof or protecting the roof before Wilma. When, after a year and one half, the association allowed them to put through a claim with Park & Associates for reimbursement for their drywall, the association did not reimburse my friends for the deductible of $14,000 (per the eight unit building). In addition, they kept the check, payable to the association to be reimbursed to the unit owner, for over $800. Fraud? The board did offer my friends $1,300, however, they refused because the damage was $15,000. They contacted the DBPR for help but instead of helping the unit owner the DBPR told my friends the association made an effort therefore, nothing could be done.

This outrageous behavior on the part of associations must stop. What good are laws if their are no consequences when they are ignored? Instead of helping my firends by insisting the association allow my friends to be able to put through their claim, the state sided with the the association and now they are out $15,000.

I would be homeless if my family did not step up and help me repair my entire home. My insurance policy paid $10,000 toward mold and the association is using the Business Judgment Law in their defense.

I have spent the last three years wri ting to state representatives, the Governor, my own state representatives and the DBPR and no one really care or will do a thing to change to law to proect the residents from fraud or losing their home because they do not have the funds to file a law suit.

Do not buy a condo until the state steps up and enforces the law they initiated. It could ruin your life!

A news story that aired 22 July reported that over 10,000 mortgage officers have criminal backgrounds. DBPR offers no protection to Floridian residents and disregards serious complaints. They do not do background checks (although they claim that they do) of the contractors and as a result FELONS ARE FLEECING FLORIDIANS everday. In my opinion the wheels of corruption just keep spinning out of control. Good for you going public. Post your story on every consumer site than you can find. Since the STATE OF FLORIDA refuses to help consumers, we need to stick together and look out for each other! Good Luck
