TODAY IS THE MOST IMPORTANT DAY OF MY LIFE, AND POSSIBLY FOR ALL HOMEOWNERS! TODAY, MY COURT CASE AGAINST WACHOVIA IS BEING AMENDED, OR DISMISSED BY A JUDGE IN THE UNITED STATES DISTRICT COURT in the Eastern District of Virginia. If we, myself and Tanya Bullock of Bullock & Cooper, Attorneys at Law, WIN THIS CASE IT IS A LANDMARK CASE, SETTING A PRESIDENCE FOR RECOVERY & PROTECTION OF ALL HOMEOWNERS!

I'm Rita Cheche of Va. Beach, the first individual in Va. (when I filed) to bring a lawsuit against WACHOVIA FOR STEALING MY HOME! This is the second of two predatory/fraudulent loans on my property by Wachovia Bank.

The two predatory/fraudulent loans have unmeasurable and devastating financial, physical, and emotional cost.

They violated my rights and the "Truth and Lending Act" T. I.L. A. I HAD NOT completed the closing documents, the closing package was not completely signed and never notarized. I could not find the 3-day Cancellation Document in the closing package, so I revised the unused 3-day Cancellation document from Mortgage Lenders Network USA, extremely high interest loan, my "Rescue Loan" from the first predatory loan with World Savings Bank/WACHOVIA. I signed, faxed, mailed, and confirmed received.

They put the loan threw anyway charging me over $30,000.00 for just one of their fees, adding approx. $60,000.00 in closing costs, and another prepayment penalty. Their loan cost me more per month then my new "rescue loan" with M. L.N. USA. They said they paid off my lender, over $636,000.00 for a property with the 100% Value being $374,432.00!!! I have sent several Qualified Written Requests asking to "Produce the Note" which they document to me that They can not produce the note. Or my Original Closing Documents, because they never had a signed notarized closing package, I have them! Unsigned. They want me to pay them what they paid my lender, which is almost $300,000.00,too much, twice as much as the property is worth. I can't get a loan, now. After I got my credit scores back in the 700's, paying ALL the financial obligations personal and businesses INCLUDING all the closed accounts, not going bankrupt personally in business. When I got this loan, I explained the fraud, Specialized Loan Servicing/Wachovia told me not to make any mortgage payments, they would have their investigators look into it and get back to me within 30 days, without reporting non payment to the credit bureaus. Then after several weeks, they said their was nothing they could do, I Paid the payments I was holding that day because I could not afford to have my scores drop. It already cost me hundreds of thousands of dollars and hours of work with credit cleanup companies and work directly with credit bureaus to get back into the 700s. They reported that I missed 2 mortgage payments, the kiss of death! If they want to be paid for a loan the did not give a penny for, committing criminal acts to produce documents (finding my signature was easy, Wachovia had my business & personal, money markets, savings and checking accounts, credit card accounts, the 9-unit commercial mortgage loan and brokerage accounts. I paid $10,000.00 for Wachovia stocks which plummeted not worth $100.00. I had Wachovia since they took over my bank, Central Fidelity about 15 years ago. They have MANY SIGNATURE CARDS, I also paid the state to authenticate the notary signature and stamp, on only 2 consecutive pages, spelled differently on each, with no possible way to read the stamp/seal). I feel if they want paid they should take that up with my who ever they gave the money to. My lender went out of business, so I should not owe anyone! They don't have to pay any of their financial obligations and DEBTS, why should they PROFIT!!! Their are several businesses who owe me, but I CAN NOT COLLECT MY MONEY because they went out of business! They did not even consummate the loan because they were suppose to give me $1,000.00 or $100.00 (approx.)depending on what set of closing documents you look at. I have 2 different sets of unsigned documents.


The first predatory/fraudulent loan draining all my cash on hand, both lied about the terms, both closing documents ALL WRONG, I TOOK MY ALL ORIGINALS,(I still have all) they did not accept my cancellation sent by fax.,mailed and confirmed received, before the 3-day period expired. They somehow, still processed the loans, neither consummated the loan. The first loan did not pay $45,000.00 to Citizens Auto Finance who conspired to unfairly ruin my credit, fraudulently reporting within 48 hours, before my 3-day cancellation period even expired, a 30 day late, NO 30-DAY LATE!!!dropping 700 scores to 513 before deceptively CLOSING ALL accounts, approx. $250,000.00 personal/business revolving accounts shooting 0-5% to 39.99% interest and Robert Bristol of Challenge Mortgage deceptively told Countrywide Home Loans, he was paying off all three of my loans with them and demanded they close my new 25-year $100,000.00 HELOC Loan, a second loan on one of my rental properties, used to build this house and going to use for retirement investing. Then stealing $2.3 million in physical assets, and my National Commercial Floor Contracting business, Ablaze Interiors Inc., started in "1986", due to credit scores "513" closing all accounts. I did not secure another contract, I could not even rent a hotel room for the crew, you MUST provide a Charge Card. I've lost 2 rental properties, a 9-unit apartment building on 3rd Bay St. in Oceanview, which provided homes for Section-8 Families. Both fraudulently putting a loan, without an appraisal, this loan, the second loan started OVER $300,000.00 the value, now it's double the 100% assessed value.

They raped my families' world, ruining our lives. Stealing our sources of income, investments and retirement, EVERYTHING!!!

We both have worked, since we were 14, now 50s'. We've worked 18 hours a day, weekends, holidays, & special occasions. The whole family had to sacrifice to provide security, and build our family wealth and retirement. Now everything is gone, WACHOVIA claims I owe them over $800,000.00 for my home worth approx. $376,000,(they can not even product the original note or any originals)

Now, we can not afford to pay our utilities, gas or even food. Much less being able to reap any benefits or enjoyment from both of us working 60 years total. Being law abiding citizens, we've done the work, making all the sacrifices, taking all the risks, weathering all the storms, paying with our lives, blood, sweat and tears! We successfully achieved the "American Dream" getting ready to have a "family life" before our son turns 18, learn how to relax, and have fun instead of being workaholics of a "working family". In 15 minutes, at Shaffer Title & Escrow with Denise sitting at a table with a man I had never met before, he fired my broker the day of my closing, knowing they were screwing me, doing everything I know to protect myself, writing all over the closing document, taking all the originals, and immediately canceling the transaction in writing. They committed the most hated sin, BETRAYAL OF TRUST...

where are you in your case against wachovia? did you stay in your home or did you move? You still have rights do not leave your home!
