Contra Costa Times Newspaper Complaint

Times Newpaper damages my car

I'm writing to you regarding a complaint of your newspaper delivery to my residence last year. I do not subscribe to your paper, however, for whatever reason your paper ends up in my driveway on occasion. I didn't have a problem with this until last fall when your paper was thrown into the right rear tail-light of my 1992 Ford Explorer breaking the plastic outer shell. The entire rear light casing needed to be replaced. I was able to e-bay a used tail light for roughly $100.00 and install myself. We tried calling your paper and did receive a call from one of your local paper representative. He simply stated that your company was not negligent for the damages and we would never receive re-imbursement. Apparently your company had hired a less than exemplary employee who had since been terminated. While I understand the frustrations of your occasional “bad employee”, and the fact that the paper was thrown by this employee, I’m dumbfounded at the lack of accountability and ownership for this event by your organization. After all, this is your product damaging my property! Am I expected to simply throw my hands in the air and say “oh well, bad luck” Picture yourself walking out for work one morning and finding your tail-light smashed by a newspaper that you don’t even subscribe to? My vehicle was not even parked in the main driveway, but on the side of the house, almost 8 feet from the sidewak and 12 ft from the curb. I also have a separate driveway on my property where other papers are delivered. There are no other cars on the street or in the driveway. How much space do you need to safety throw your paper without damaging my property? The fact that I should be expected to “eat” this expense is absolutely ludicrous. I’m most irritated that your representative would simply call my wife at home and tell her she could do nothing about it.

We both know that $100.00 is hardly worth me seeking legal action. Rather, with this letter, I would hope your Newspaper simply does the right thing and show me the courtesy and respect I deserve as a result of your negligence. We have not even received so much as an apology. I can produce pictures and a copy of my receipt for the damages should someone over there decides to come to their senses. If I do not hear back before Jan 31st 2006, I will assume your silence means you simply do not care and my actions will be directed elsewhere. Channel 7 on your side comes to mind.
