I live in a small town called Somerville, TN, Fayette County. My son's name was forged by a well known car dealership, Jim Kerras Chevrolet. We would not have known this, had his vehicle not gotten stolen.
The dealership could not get the Lienholder, Capital One Auto Finance to Finance the Loan unless a downpayment was made. The dealership called the next day and asked for a down payment. My son, an Iraqi Veteran, said no, and give his traded car back. We never heard from the dealership again. Then ten months later, my son's new vehicle was stolen. The Lienholder, Capital One told us to cancel a maintenance plan.
The dealership had sold the business however, they own several other businesses in Memphis, TN. The new dealership gave us copies of the contract. Then, I realized that I had the original contract, and a down payment was made, and my son's name was forged on the contract that was sent to the Lienholder. I notified the insurance company, the dealership, the gap, and the bank.
I went to the police to file a report, and no one in Somerville, Tennessee will take a report. The DA, said he didn't want to touch it. The Captain of the Detective told me to call Channel 3 news, and no attorney in Somerville, TN would take the case. It was very difficult to find a Consumer Lawyer, we only found one, over a month ago. The bank is calling us several times a day, including Sundays, the dealership has never been contacted, and we don't have any one to turn to.
We contacted the local News Channels, Katie Couric, the FBI, TBI, and US Marshalls, as well as the Governor's Office in Tennessee. No one will help us. Needless to say, the dealership is rolling over laughing at us, like we are some poor lepers living in a town, where every one knows everyone and we dare not make too many waves or our family may be profiled, or worse.
