Surprise Rent Increase for Seniors in a Home

The rent for room and board is set at 47.5 % of your total income from all current sources. It is not set on net worth bank accounts, property owned, etc. just current income.

A resident upon entry to the home was in the process of collecting a lawsuit from a past employer who had refused to pay the resident back pay. Since this money was not current pay or income but a settlement of a debt owed the home to my mind correctly determined that the money was not part of the rent payment.

New management arrived at the home and reviewed all financial accounts and decided that the past decision not to collect those funds those funds had been in error.

The resident is no longer receiving any of those funds and now has only social security and disability funds.

The home decided that the resident had to pay $17,000 dollars. They reviewed with the resident his current income and decided that there was no way for the resident living at his currently poverty levels to make up for the back rent, and so told him that he would have to leave the home and somehow get by on his current income.

Now the resident at the time of entry had the option of accepting his law suit settlement either as a lump sum or as a monthly payment and based on the homes finding decided to take the money as a monthly payment.

If based on the ruling he had decided to take the money as a lump sum he would have had to pay $400 dollars extra in rent for one month.

There is rather a large difference between $400 and $17,000 dollars, based on the homes past decision. Of course our resident ex-lawyer has stated that there are several legal decisions and principles of law that support the resident but not the home, but the resident does not have the funds to hire a lawyer and as a homeless person living out of his car, he would never have the money to hire a lawyer.

The upshot of this story is that this senior wounded warrior and veteran has no place to go, except to be homeless in his car.

I personally think that there is a degree of racial prejudice in this ruling.
