Big insurance company against one small person

How much can a big insurance company put you through, in this case the company is LOYA INSURANCE COMPANY.
Story…

Person backs car on a parking area in to my cars rear-end while I am parking on the opposite side; the car driver is sorry and gives me all information needed so I can fix my car through LOYA insurance company. So far everything is fine. I call the LOYA insurance company and give my estimate from my car dealer for how much it will cost (the car dealer tells me: that I probably will get in trouble with LOYA they have had a lot of problems for payments before from LOYA). LOYA gives me a claim number and wants me to wait 3-4 days so LOYA can send someone to take pictures of the part that has been damage and in return estimate the costs.
It took them 7 days and LOYA estimated the cost for half the price, now I am getting upset, who is going to pay for the rest. Now LOYA is starting to blame me for being irresponsible and LOYA suddenly wants me to,-“pay more attention” when parking so I have to take that.
I want LOYA to take their responsibility and pay I had nothing to do with the accident, I could of left the car and still it would have happened. But according to LOYA I should have honked or somehow given notice of my appearance to the other car.

I had had my car fixed at this time and it is now 2 weeks after the accident. I am supposed to get my car. BUT LOYA has not sent me any check. I call LOYA and LOYA has made a mistake sending the check to wrong address: how can you send my check to an address that I have not given you? Answer from LOYA clearly you gave us this address. NO why would I give you an address that I am not living in!!
LOYA promises to send a new check to my right address, nothing happens. I call LOYA again after 3 days now LOYA says that I have to wait till the wrong address check has been VOID so they can send a new one.

I ask what address they will send the new check too and LOYA gives me the wrong address again. Now I want LOYA to definitely change my address. I still have no check and no car.

Where is the responsibility from the BIG company, what am I suppose to do???

It is now 4 weeks and LOYA has done nothing my car is waiting for me, but how am I suppose to pay 1300$ just like that I am not rich as LOYA and I am very much innocent. I want everyone who has to deal with LOYA INSURANCE COMPANY to know about this event and let them be aware of what kind of insurance company LOYA is.

ONE lonely person who JUST wants justice against the BIG Company.

Get a lawyer as quick as possible. Most lawyers that deal with property damage and/or personal injury resulting from negligence of another person, will usually give a free consultation and will charge on contingency. Contingency means they don't charge you anything if you don't get an acceptable settlement or if the case gets dismissed in court if it goes that far. They give the free consultation in order to make sure your case has a really good chance of being settled sufficiently, or will stand a good chance of winning in an actual lawsuit filed with the courts. The only thing you have to do is open the phone book and call Personal Injury Attorneys listed.

An even better way of finding an attorney that will do the best job of getting the highest settlement possible would be to ask your friends, family, and co-workers if they were ever in an accident and if the lawyer they went through was good, and get contact info.

In my opinion, the best way to find a good lawyer is from word-of-mouth refferals.

Hello, I got a lawyer because i was rear ended by a guy who had Fred loya Insurance. And my lawyer stated they would try to low ball me though it was clearly his fault because he got the ticket. Trust me if you havent already take the other persons advice along with mine. Get a lawyer.

On 7/22/09 I was hit by someone insured by Fred Loya Insurance. I was driving through a parking lot and a man backed out of a parking space
and hit me so hard it did over $3, 000. of damage to my vehicle. I had to go to the ER and my medical bills are $7500. so far. My shoulder needs
reconstructive surgery that will put me out of work for up to six months. I can not have the surgery because I will not have the money to live on and the policy limits would not be enough to cover the cost. Loya Insur. Co. declared they would only pay 90% of the claim, even though the driver said he saw me comming and backed out anyway. I was forced to get a lawyer
for the bodily injury. The adjuster with Loya Insur., Glenn P. Johnson only offered $2, 000 today on 01/12/10. I am haveing to go to court just to get them to pay my medical bills, not counting everything else I have been through
and will have to go through in the future. This company is known for not paying their claims.

I do know what you are talking about I got hit from behind on the freeway during rush hour the traffic came to a complete stop all of the sudden he got the ticket on the police report he stated that I stopped and he hit me His insurance company is Fred Loya he told them that i was changing from lane to lane in front of him a different story (from the police report)and fred loya is only paying me 90% also they send me a check within 8 days and said this all that they are paying the damage is double of what they send me and I told them I will not except the check now I have no Idea what to do bc I call them back and told them I was going to take them to small claims ct. I really don't have time for all of this I hired a lawyer however he only is working on the medical part and wants me to use my medical insurance I still have to pay out of pocket and I cant afford it I need help. jess
