Bank of America, NC Attorney General Complaint

Bank of America bought FRAUD loans and still processing them without contacting - Fraud Loans

- Greensboro NC
Hello,
My family and I hope this email reaches someone of importance and fills them with the understanding of what we have endured the past 3 years. . I am sending this letter in reference to Bank of America account # 022554395. Just as an introduction to why this email has strong intent to reach you. For 3 years now we have been a victim or one of the families that was burned by the scam of Taylor Bean or Phoenix Housing and according to the Attorney General office our case was the worst of all the other families; considering it was a roughly $55,000 purchase that turned into a $200,000+ 30 year mortgage to an 80+ year old dementia diagnosed old couple, not to mention it was laid on our own land. The workers at “Phoenix Housing Group Inc *Southern Showcase Housing*” swindled my grandparents into purchasing what was then supposed to be there dream home which over time has turned into a family nightmare. At the time this deal was put into place my grandparents were already in a substantial amount of debt with very strict income. The worker made them sign several papers that they could not comprehend neither did she explain to them what they were signing. To this day we have yet to receive any signed mortgage papers. After the paperwork was done it took them a substantial amount of time to lay the home, which triggered my attention and that is when I started reaching out to the Southern Showcase worker; I clearly told them that we needed to see what was done and know what paperwork was placed for this transaction. About a week later they came and cleared the land and shortly after laid the home. After we discovered the home was laid my grandmother told me that the home was not the one they had choose. So at that point I knew actions needed to be taken. We made several attempts to contact the worker or manager, and later found out that she was no longer working there. We contacted the mortgage company and explained what happen and one of the workers there said that something is wrong with the paperwork which they told me that off the record, and they stated that something does not seem right. So my family and I started trying to figure out what was the next step. We contacted the Attorney General’s office and were referred to George Leggett and after explaining to him what had transpired he stated that we had a serious problem. After time we found out that we were not the only family that had been in this situation. When the negotiations were started our family was told that our case was the first case they wanted to complete because of the nature of our case according to Mr. Leggett. Well as time went on we received word from the Attorney General that the lawyers wanted to settle with us. So as a settlement to our case they wanted us to give up land or take a loss to our investment, like there was no fraud against us at all. Well we refused their offers because we clearly thought it wasn’t right for us to suffer for something fraudulent. So out off most of the families we didn’t let our loan go into foreclosure because we had land that we could not let get taken. At the current time my grandfather (ex-veteran) has been in several Alzheimer's disease care centers for 2 years now which we are getting no assistance with and my grandmother (retired school worker) has been living with relatives off and on since he was admitted; with this being said neither of the two have been able to enjoy or move-in the home since it was built. Our loan was sold to Bank of America after Taylor Bean went bankrupt. Bank of America has not tried to contact us or anything to restructure this loan or correct the fraud. The mortgage is for over $1000 monthly which we have been struggling to pay for; we have sold all farm equipment just to keep this loan paid monthly. Also Bank of America has been paying the property tax on the wrong home which that is supposed to be factored in the loan payments. This has truly been a burden to my family, nothing positive have come from this at all.
