I am listing in this letter what has happened regarding Phil Grant Enterprises, Inc of 1800 ElJobean Rd. Port Charlotte, FL 33948-1260, Phone # 941-743-7566.
Phil Grant Enterprises, Inc. completed an extensive remodel job to my pool on 2-21-07. This job included adding an in ground spill over spa, Intelli Touch Pool and Spa Master Control System, Aqua Rite Electronic Chlorine generator system by Goldline Controls Inc., Larger size pavered decking and many other cosmetic items totaling just under $40,000.
Mr. Grant included a five year warranty against any structural pool and spa concrete shell cracking. I had too many problems and redo’s to list with this remodel job that for the most part Mr. Grant did remedy. However I was not happy with the paver work on the pools decking which after several months of back and forth with Mr. Grant, I finally made my final payment and accepted the pore workmanship only because I was tired of dealing with all the problems. On 9-13-08 I hired Geraldo Souza a paver installer to redo the sloppy job Mr. Grant left me with totaling $935.00, which I paid for myself with no intentions of at the time trying to collect from Mr. Grant.
On May 14, 2010, I mailed a letter to Mr. Grant informing him of several structural concrete cracks in both the pool and spa’s shell, some big enough that the pool was leaking water.
On August 7, 2010, Mr. Grant completed all leaks and structural crack repairs at no cost to me as he warranted all this work.
On August 7, 2010, I mailed Mr. Grant a letter thanking him for the repairs and informing him that the persons that made these repairs did not match the interior pools “Pebble Tec” finish in any way shape or form. Leaving me with a large scare down into the pool where the largest of several cracks were repaired.
On August 11, 2010, Mr. Grant responded to me with a letter stating that he would not be correcting this problem. I contacted the original subcontractor that Mr. Grant used to install the “Pebble Tec” finish at the time of the remodel job. Some time just after Aug. 11 2010 receiving Mr. Grant’s response and spoke on the phone with the owner, Ronda of Siesta Pebble Tec (239-567-1678). Ronda said that she did not install the patch work Pebble Tec finish at the time of the crack repairs and that the color finish I originally had that was installed by Ronda’s company is no longer available. She informed me that to properly fix this problem I would have to refinish the entire pools finish. She gave me a verbal cost of $5,500.00.
Mr. Grant has been properly informed and as of today’s date has not remedied the patch work. As for the most recent and certainly dangerous problems to my pool I have discovered Mr. Grant failed to install the Intelli Touch pool and spa master control system properly. As a result this system does not communicate with the Aqua Rite Electronic Chlorine generator system. This Intelli system is compatible to the Aqua system and if installed together the Intelli system has a built in fail safe feature that is out lined in the Intelli systems manual that it will shut down the aqua chlorine generator by 1/20 when the pool is in spa mode. This lowers greatly the amount of chlorine being generated making the spa safe to be in.
On 3-14-2011 I contacted Dart Services of 1181 S. Sumter Blvd. Pmb 324, North Port FL 34287 Phone 800-760-3278, a company local to me recommended by Intelli Touch. They came out and confirmed my findings and quoted me $145.00 to remedy. As a result of the Intelli Touch system not being installed properly I have had several people hurt over the years while setting in my spa also three different cases of their jewelry coming apart while setting in my spa. My fiancée’s engagement ring and another married couples both wedding rings all three on the same night. We didn’t know what to think at the time, fortunately the other couples rings were insured and was repaired at no cost to them. This couple is willing to make a statement; unfortunately they don’t have any receipts at this time.
On March 24, 2010 I did have my fiancée’s (Deborah Handlon) ring repaired by Al Morgan at 119 W. Marion Ave Punta Gorda FL 33950 Phone 941-637-0946 in the amount of $190.00 to replace the head and reset a stone. I am including this cost from Al Morgan after reading what chlorine does to jewelry on the internet.
As for people being hurt, my fiancée (Deborah Handlon) has received $4,759.51 in medical bills not covered by insurance and $238.44 in medication bills. I also was burnt one time most recently setting in the spa this is when I figured out what was happening with the chlorine. As for me, my skin is not as sensitive as Deborah’s so I toughed it out also my burns weren’t as bad as Deborah’s problems. However after advisement from legal services I did get a check up on 3-8-11 by the Family Medical Walk-in Clinic at 2310 Tamiami Trail, Ste 2101 Punta Gorda 33950, confirming that I did have a skin irritation from shoulders down, this costing me $150.00. Deborah Handlon also has Asthma which also was greatly affected, this is why her medical bills where as much as they totaled.
I have all corresponding letters between myself and Mr. Grant, all receipts, all pictures taken of all pool problems and I estimate a total of $11,772.95 in Loses not including legal fees.
In regards to Deborah Handlon, the amount of her medical expenses included in the above is our out of pocket only. This amount did not include what was paid by her insurance company. Also, her asthma has been greatly affected; we believe it to be as a result of the high levels of chlorine.
On June 30, 2011 I have called Dart Services and had them hook up the IntelliTuch Properly. Still no satisfaction from Grant.
