In 2006 Dr. Wortman, my dentist at that time found I had an abcess in a tooth that I had a crown on. He said that he could do the root canal and use the same crown, which he did. Almost. I changed jobs and dentists and now go to Hoffman dental practice. The crown that I had on the tooth that Dr Wortman worked on became loose. I didn't think it was a problem so I went to my present dentist. They removed the crown and x-rayed the tooth. The dentist asked me if I knew why the previous dentist didn't fill all of the canals. I told him I didn't know he hadn't. The bad news was I would need another root canal on the same tooth. Needless to say this didn't make me really happy. I don't look forward to them, and to have two root canals on the same tooth is a bit over the top.
I called Dr. Wartmans office and told them I wanted a refund on the first root canal because it was never finished. That seemed fair. The next day Dr. Wartmans wife called and told me that since the statute of limitations had run out they didn't have to do anything. I explained that there was no statute of limitation on ethics. I gave them a copy of the referral to the dentist who was doing the new root canal and the paper giving the reason for the new root canal, which was an incomplete root canal.
I don't think that I am being too demanding. I just want my money back for bad and incomplete work. I understand that the Statute of limitations is two years, but there is a discovery rule that says "Sometimes it is not reasonably possible for a person to discover the cause of an injury or even to know that an injury has occurred, until considerably after the act which causes the injury. " Since I really would prefer not to get involved with a lawsuit, although, it might become necessary, I would like some help in this matter. Root canals are expensive as are crowns and my husband is disabled and I am a school bus attendant. We do not have a huge income.
