My Attorney’s letter to AAMCO
On April 25, 2011, my clients were advised by their regular mechanic that their vehicle required repairs to its transmission. My Client contacted your company to secure a ballpark figure for the necessary repairs and was advised that the work would usually cost $1599 plus tax. Based on this conversation, My Client brought the vehicle to your repair shop at New Brunswick, NJ during regular working hours to secure an estimate of the necessary repairs. My Client was told that you would contact him later that day with a formal estimate. It is my understanding that My Client was not advised that there would be any charge for diagnostics and did not sign any written authorization for such work to be performed.
On April 29, 2011, your company sent a written quotation sheet via fax to my client that estimated the costs of repair to be $4,814.09. When my client refused to authorize the work, I understand that your company refused to release his vehicle unless he paid a diagnostic fee of $1,200. I further understand that you are now demanding that he pay a storage fee for his vehicle.
As you are undoubtedly aware, it is illegal under N. J.A. C. 13:21-21.11 for any repair facility to commence any work without specific written authorization of the customer. Kindly provide my office with a copy of the written authorization for the diagnostic work and the estimate of the charges for the diagnostic work. In the absence of such records, I recommend that your facility immediately release the vehicle to my clients. Failure to do so will result in the commencement of litigation for violation of the NJ Consumer Fraud Act seeking injunctive relief to compel the release of the vehicle and an award of treble damages, attorney fees and costs.

Note: Today is the 26th day and still they haven’t released my car. Be careful if you use AAMCO. Don’t be a victim like me. I am sure they haven’t touched the transmission and all the work they are suggesting is not required either. The managers want to grab my money as their high commission.
