A Family Fights Due To A Modification Scam by Wells Fargo Home Loan - Mortgage Modification

In June 2011 Channel 34 advertised that Wells Fargo Home Loan was having a Modification Event in Orange County. After Being laid off of my job after 14 years of service, my 67 year old mother and I who I own the home with (we bought it in 2002) decided since we need help to attend. After hearing about all the modification scams we felt comfortable since our loan was with Wachovia and they had merged with Well Fargo a well known banking institution. After a long wait we were assisted by an agent who informed us he resided in San Antonio, Texas and would be our representative from the beginning of this process to the end. He was pleasant enough even though he hinted frequently that he would like to be invited to our home for a home cooked meal since on the road. We had most of the required documents with us but there were still a few he needed and being that he would be getting home just before the July 4th holiday he gave us a date to fax over the rest of the documents needed. I went to my neighborhood Wells Fargo Branch location with my documents and had them fax everything over for me which they gave me the confirmation slip. I spoke to him on the phone confirming that he received everything and he called me back a few days later to tell me everything had been submitted and that we just had to wait now. A week later my mother received a call that it had been rejected without reason. We just decided to put anything further on hold and do some more research. We continued with our monthly payments, we struggled but we made sure we were never late or missed a payment. In November 2011, we received a letter from Wachovia/Wells Fargo stating that our payment was now $600 more a month. We went to make a payment (not the increased amount) and they denied our payment so we called to find out what the payment increase was about. They said due to the modification they had opened an escrow account and due to that they paid our property taxes. We told them we were denied months ago so why would this happen. We also told them that we paid our property taxes on our own and besides after the one more payment just due it would be paid for the year. We also told them that the increase added up to double the taxes for the whole year it was robbery. They then said well if you go to the bank make the payment amount that they paid for the taxes and fax a letter requesting Escrow to be closed everything would go back to what it was.(We had to fax it twice because they said that they didn't receive the first one.) After a couple days we called to check up on it and they said it was denied and that we had to continue paying the new higher amount. We tried to argue telling them that we went to them for help to lower our payment not make it higher and the only help they were offering was to help us lose our home. They refused to help and now are saying that we pulled out of the modification. We told them no way we did everything asked and if they had it in writing of course the answer is no. Everyday we get numerous calls from some nasty person telling us to make our payment. We then requested the money back we paid them back for the taxes and they said just make a request and we'll send it back. Guess what they denied that too. And want us to pay November and December payments. This was a fraudulent scam and it was a BIG mistake to try to modify with them. We went from struggling every month but never being late or missing a payment to the impossible. We are stressed out and I worry about my 67 year old mother. There is nowhere to turn to for help and they continue to get away with this. If anyone can help we are getting desperate.
