Mid Peninsula Regional Open Space District Complaint

60 foot oak tree destroys cars in MROSD parking lot - Public Safety

- Fremont Older Open Space
I went to Fremont Older in Cupertino for a hike with a friend and when I returned to the parking lot I retrieved something from my car, as I was a few steps from my car a 60 ft. oak tree cracked and fell directly on my car destroying it. It also hit two other cars. I have been working to try and have my car replaced by the park district, but they are denying liability. The tree was rotted and posed a threat to life. My car was parked in a designated parking area, the ranger told me the tree was rotten - obviously. The park turned the case over to their insurance and they are refusing to accept liability or to restore my car. I have a 50 mile commute every day and this is my only car. I cannot believe that the government is less liable than say PG&E. That they can just say you took the risk to park in our lot and you are just out of luck. This is another representation that we as citizens and taxpayers are just to be used and abused - no one answers to us, but we answer to them. Whatever happened to a government of the people, for the people and by the people. Just remember if something bad happens to you in a public site, government domain, then you are probably going to be so out of luck. If I had been in the car a few seconds longer I might have been seriously injured or killed. My family would have been responsible for medical or death costs. This is so completely outrageous that we the people must stand up and say we are just not going to accept this from the government that we pay for, that works for us, that has a duty to perform just as responsibly as they demand we perform. I now have no recourse and have no car. They however continue business as usual.
